1. Introduction & Acceptance

Welcome to WE Leads Pty Ltd ("WE Leads", "we", "our", "us"). We provide data brokerage and lead generation services to real estate professionals and other industry partners. By using our website, services, or purchasing our products, you ("client", "you") agree to be bound by these Terms & Conditions.

If you do not agree with these terms, you must not use our services.

2. Service Description

WE Leads offers lead generation and data brokerage services including, but not limited to, providing manually verified contact information such as:

● Full names

● Residential addresses

● Phone numbers

This data is supplied for professional marketing, prospecting, or client acquisition purposes, and may be accessed via email delivery or via integration with CRMs (Customer Relationship Management systems).

Availability of services is dependent on current workload, data access, and verification procedures. We do not guarantee uninterrupted service.

3. User Obligations & Restrictions

By using our services, you agree to:

● Use the data solely for lawful business purposes

● Abide by all relevant Australian legislation including:

○ Privacy Act 1988

○ Spam Act 2003

○ Do Not Call Register Act 2006

○ Competition and Consumer Act 2010

You must NOT:

● Use data for spam, fraud, scams, or harassment

● Contact individuals who have opted out or are on the Do Not Call Register unless you have valid consent

● Redistribute, resell, or sublicense our data without written permission

4. Data Quality & Disclaimers

WE Leads provides data on an "as is" basis. While we verify data manually, we cannot guarantee it will always be complete, current, or error-free. You acknowledge that:

● Data may change over time and may not reflect real-time updates

● We are not liable for any action taken based on inaccurate or incomplete information

● Our liability is strictly limited as described in Section 9

5. Payment Terms

Pricing is based on the number of contacts purchased, as communicated in your custom package. Payments are accepted via electronic bank transfer or card.

● Payment is due before delivery of data

● No refunds will be issued for data already verified and delivered unless otherwise agreed

6. Privacy & Data Protection WE Leads respects and complies with the Australian Privacy Principles. Please review our Privacy Policy for full details on:

● How we collect, store, and use personal data

● Security measures in place to protect your information

● Rights of individuals to access, correct, or request deletion of their information

7. Suburb Exclusivity

If you purchase a data package for a specific suburb, you will have exclusive access to that suburb's data for your use only. We will not sell the same data twice. To maintain this suburb's exclusivity, you must place an additional order or purchase more data from WE Leads within three (3) months of your last order.

If no new order is placed within that time frame, WE Leads reserves the right to offer that suburb to another agent or client. Exclusivity is maintained only through continued activity.

8. Indemnity

The client agrees to indemnify, defend, and hold harmless WE Leads Pty Ltd, its directors, officers, employees, agents, and affiliates (“WE Leads”) from and against any and all claims, losses, liabilities, fines, penalties, costs (including legal costs on a full indemnity basis), or damages arising from:

● Any breach by the client of the Privacy Act 1988 (Cth), Spam Act 2003 (Cth), Do Not Call Register Act 2006 (Cth), or any other applicable privacy, marketing, or consumer protection laws in connection with the use of data supplied by WE Leads; and any unauthorised, negligent, or unlawful use, disclosure, or processing of personal information by the client or its representatives. The client acknowledges that it is solely responsible for ensuring that all outbound communications and marketing activities undertaken using data supplied by WE Leads are lawful, consent-based, and compliant with all applicable regulatory requirements.

9. Limitation of Liability

To the fullest extent permitted under Australian law:

● We are not liable for indirect, incidental, or consequential damages

● Our maximum liability shall not exceed the total fees paid by you in the 3 months prior to a claim

● We are not liable for delays or failure due to force majeure events This does not affect your rights under the Australian Consumer Law.

10. General Legal Provisions

● Governing Law: This agreement is governed by the laws of New South Wales, Australia.

● Dispute Resolution: We encourage resolution via good faith negotiation. Failing that, disputes will be submitted to a mutually agreed mediator.

● Entire Agreement: These Terms & Conditions represent the full understanding between parties. ● Amendments: We may update these terms at any time. Continued use of our services implies acceptance of the latest version.

● Severability: If any clause is found unenforceable, the rest of the agreement remains valid.
